BASIC ADVICE: DO NOT MAKE ANY STATEMENTS
Invoke your right to remain silent. You are not required to give a statement to the police so don’t. You have the right to an attorney so SPEAK WITH AN ATTORNEY. If you are accused of any crime remain silent and seek legal advice immediately. Give your name and address and let the police know you want an attorney. Do not agree to anything until your attorney tells you to do so.
WORK WITH YOUR ATTORNEY
Be honest with your attorney. What you tell your attorney is protected by the attorney – client privilege, which means what you tell your own attorney will not be used against you by the State. Basic decisions in a case are for you to make, you decide whether or not to exercise your rights; the attorney will do what she or he can to “paddle” in the direction you “steer”. Don’t lie to your attorney. Lies will probably be found out and backfire. Be completely honest with your attorney since your attorney is probably the only one who will stand up to the police and prosecution for you. Cooperate with your attorney. Be on time for appointments. Keep in touch and be sure your attorney can reach you and knows your address. If you are on probation or parole be certain to let your attorney know about it. Likewise, if you get stopped by police for a different crime while you are out on bail and waiting trial tell your attorney about what happened.
WORK WITH THE SYSTEM
Show up for Court a little bit early and dress like you were going to church or an important meeting. How you act and what you look like will make a lasting impression on the Judge and the jury. Behave yourself in Court. Speak only when asked. Speak respectfully. Use “Yes your Honor” and “No Your Honor”.
Saying “please” and thank you” can make an impression on the jury. Common courtesy will help you in the long run. YOU MUST BE CIVIL AND POLITE. If you are in jail how you act there may affect what will happen too. Don’t swear at the jailer-he or she is only doing their job. If your being treated poorly tell your lawyer-don’t complain to the jailer or you may find that your stay in custody will become more difficult. Listen to any questions you are asked and think before you speak. Do not just blurt out an answer. Do not get mad. A common tactic is for the questioner to try and make you mad so you make mistakes-don’t fall into this trap. Keep your cool.
